Just wondering if anyone knows how you stand if there's an accident at bunnings? Is it true that the rules are different as it's private land and not public..I know it's a silly question but I tried to look it up and being hopeless couldn't find anything so any help would be most appreciated :) and this is for both parties involved.
I guess it will depend on the state you are in because the states have different road rules although they are all based on "The Australian Road Rules". It would also differ between traffic law and civil liability. For Example if 1 party went through a stop sign in a private car park then it may not be an offence under the traffic act but if it went to a small claims tribunal then the person hearing the matter would place a great deal of weight on it. Carparks are (often) "public places" but they may not be "roadways".
Not much help but good luck and if you are in the right and the other person won't come to the party then consider taking them to your version of "small Claims". Here in Qld the parties get their quotes and prepare their material and the matter is decided "on the papers". No need to set foot in a courthouse.
If both parties are talking and it is just to come to a fair conclusion then consider using a free mediation service.
